Setúbal combines three things that weigh on a roof: the sea, a very hot summer and nights that still bring frost. It also has a recent municipal regulation, from 2025, with its own articles on roofs in the historic centre and in Azeitão. This guide says what can be confirmed in official sources for anyone who has to repair a roof in the municipality. What applies across the country is in the national guides, and we link to them. We do not repair roofs: we give information, with sources.
Updated 3 November 2026.
The essentials
- Repairing the roof to keep it as it is needs no permit, under the national rule. Even when exempt, Setúbal’s regulation asks you to tell the council at least 5 days ahead and to name who does the work.
- The historic centre and the Azeitão cores have rules on roofs. Among them, traditional ceramic tile may not be replaced by tile of another colour or glazed tile, nor by asbestos-cement or corrugated sheets.
- In those places you may not fit gutters on street-facing facades.
- Only 2.3% of the municipality’s buildings need deep repair, against 4.6% nationally. That does not mean your roof is fine.
- Storm Kristin: the council counted 1,149 incidents. Setúbal is not on the official calamity lists.
What Setúbal’s numbers say
Setúbal has 24,631 buildings in the 2021 Census (INE). Of these, 18.5% date from before 1961 (national: 23.1%) and 21.1% were built after 2000 (national: 17.9%). It is a municipality of middle age.
On condition: 24.3% need small repairs (national: 21.8%), 7.1% medium repairs (national: 9.4%) and 2.3% deep repairs (national: 4.6%). Together, 33.7% need some repair, against 35.8% nationally. The figures are for the whole building, not the roof.
This points to many small fixes and few heavy jobs. Small repairs mean 5,985 buildings.
The climate and what fails first
At the IPMA station Setúbal / Estação de Fruticultura (1991-2020) it rains 703.3 mm a year, and on 9.4 days the rain passes 20 mm. The biggest daily downpour was 89.2 mm, on 19 February 2008.
What sets Setúbal apart is the range. There are 6.5 days a year with frost, with -4.8 °C on 9 January 2009. And there are 56.2 days at 30 °C or more, 13.3 at 35 °C or more and 45.5 °C on 4 August 2018. Tiles and flashings expand and contract a lot.
Link this to the APICER and CTCV guide, which we use in the tiles and climate guide. In frost areas and by the sea, flaking of the tile can come from frost or from salt. The guide advises tile with proven freeze-thaw resistance and low water absorption, and says to replace a tile that flakes. So after a frosty night or a sea storm, look for chipped tiles, ridge tiles and flashings. With 56 hot days a year, roof ventilation also counts. The same guide ties most defects to lack of maintenance.
Permit and council rules
The national rule is in the permit guide: conserving (restoring, repairing, cleaning) is exempt. Setúbal’s Municipal Building and Urbanisation Regulation (Aviso 15851/2025/2, Diário da República of 26 June 2025) adds the following, from the articles we read:
- Article 18. Exempt works remain subject to inspection, fines, stop orders and demolition if they break the rules. The person responsible informs the council that work is starting, naming whoever is in charge, at least 5 days ahead.
- Article 19. Replacing the roof covering with another that has an identical finish to the original and improves energy efficiency counts as a work of minor urban relevance. So does fitting gutters and downpipes, but not in the Historic Centre.
- Articles 67-A to 67-E (historic centres). They apply inside Setúbal’s walls, in Bairro Salgado and in the historic cores of Vila Nogueira de Azeitão, Vila Fresca de Azeitão, Aldeia Rica, Aldeia de Irmãos and Oleiros.
- Article 67-C (roofs). When a roof is replaced, its shape, volume, appearance and original eaves are kept, unless technically justified. Traditional ceramic tile may not be replaced by tile of a different colour, glazed tile, asbestos-cement or corrugated sheets. Roof windows (“velux”) only on slopes that do not face the street. Existing skylights must be restored.
- Article 67-E. Downpipes should preferably be set into the wall. Gutters are banned on facades facing public streets.
One more practical point: when rehabilitating, removed material should be reused where possible, or replaced by material of the same nature and quality (article 67-B). Ask the contractor to state it in the quote.
Who to ask at the council
The council has an online services platform for private planning operations. On the municipal services contact page, Urbanismo (“Para obras particulares”) is listed with telephone 265 247 891 and email [email protected], on working days 9:00-13:00 and 14:00-15:30, preferably by appointment. The building is Ciprestes, at Avenida dos Ciprestes 15. For rehabilitation and ARU, the council’s page gives [email protected] and telephone 265 247 810. Ask in writing whether your work is exempt and keep the answer. For a flat in a condominium, see who pays.
Aid and benefits
- ARU Setúbal Central. The Municipal Assembly approved the new boundary on 17 July 2026 (Aviso 23810/2026/2, published 25 September, corrected 16 October). The 2023 one had lapsed. The council says ARUs allow tax benefits mainly in municipal taxes and fees. The notice mentions IMI exemption for three years and IMT exemption on purchase for rehabilitation. There are also the Setúbal and Azeitão ARUs, from 2021.
- VAT. Being in an ARU is one of the conditions for reduced VAT: see the VAT guide.
- Aid for roofs. We found no open municipal programme for private roofs.
Storms and emergencies
According to the council, Kristin caused 1,149 incidents and damage of 56,703,516.81 euros, 101 of them from fallen trees on 28 January. On 18 May 2026 the councillor said how to access PTRR money was not yet known. See the aid guide.
In immediate danger, 112. The council’s emergency page lists Municipal Civil Protection, at the Sapper Fire Brigade barracks, on 265 739 330 and 265 739 335. The council also has an “SOS Setúbal Cidadania Ativa” channel for incidents. If the roof is already damaged, follow the first 48 hours. Then compare quotes in the quote checker and check the contractor. To decide, see repair or replace and the repair hub. More data in Roofs in Setúbal.
What we could not confirm
- Setúbal’s rules outside the historic centres: we read the building regulation, not the PDM.
- Whether your building is inside the Historic Centre boundaries: confirm with the council.
- The amount of fees and exemptions.
- An open municipal programme for private roofs.
- The exact Urbanismo contact for each type of work, which the page lists in blocks.
- How many roofs Kristin damaged in Setúbal.
