## Summary

- Classified buildings or those in the process of classification: works and interventions need authorisation and monitoring by the heritage body (Lei n.º 107/2001, article 45).
- General protection zone of 50 m: works that change the roof or exterior cladding need a prior favourable heritage opinion (article 43). Ask the Câmara in writing before ordering.
- Even repairs may have rules: in Guimarães the Câmara asks for a licence in the classified area; in Évora the plan has rules. The answer changes from municipality to municipality.
- On the coast and islands, one manufacturer treats the site as «exposed», with more slope, and APICER names salt as a cause of tile flaking.

Some roofs come with more rules than others: those on classified buildings or near them, those in historic centres and those in places with wind and salt, such as the coast and the islands. They are two audiences, but the questions start the same: what can I change, who authorises it and what care does the place demand. This guide reads the heritage law and what a manufacturer and APICER say about the sea and the wind. We do not name firms or give prices.

## The essentials

- **Classified building, or one in the process of classification:** works and interventions need authorisation and monitoring by the heritage body (Lei n.º 107/2001, article 45, no. 3).
- **Protection zone:** 50 metres from the building, automatic. Changing roofs or the exterior cladding needs prior favourable heritage opinion (article 43, nos. 1 and 4).
- **The Câmara is the front door.** Ask it, in writing, whether your building is classified, in a protection zone or in an ARU (urban rehabilitation area).
- **Coast and islands:** for one manufacturer, it is an «exposed» situation and needs more slope. Salt can make the tile flake (APICER).

## How to know whether special rules apply

There are four cases, which can add up:

1. **The building is classified** (of national, public or municipal interest) **or in the process of classification.** The law has these three categories (Lei n.º 107/2001, article 15).
2. **It is within 50 m of such a building.** This is the general protection zone, which applies from the decision to open the procedure (Decreto-Lei n.º 309/2009, article 37).
3. **It is in a special protection zone**, set by ministerial order, which can be larger and have its own rules. The buffer zone of a World Heritage property counts as a special zone (article 72, no. 2).
4. **It is in an ARU or a municipal plan** with rules for roofs. See [Évora](https://telhadoseguro.pt/en/roof-repair/evora), [Porto](https://telhadoseguro.pt/en/roof-repair/porto), [Guimarães](https://telhadoseguro.pt/en/roof-repair/guimaraes), [Lisbon](https://telhadoseguro.pt/en/roof-repair/lisbon) and [VAT in ARUs](https://telhadoseguro.pt/en/guides/roof-works-vat).

## What the law says

| Situation | What it requires | Where |
|---|---|---|
| Classified building or one in the process | Authorisation and monitoring by the competent body. Design by a technician with recognised qualifications and, at the end, a report on techniques and materials | Lei 107/2001, art. 45 |
| Classified monument, ensemble or site | No work, inside or outside, without express authorisation and monitoring | art. 51 |
| Protection zone | Without prior favourable opinion, the Câmara cannot license works that change the roof or exterior cladding. Interior-only works are left out | art. 43, nos. 4 and 5 |
| Protection zone of a building of national or public interest, or in the process | A licence or prior notification without that opinion is void | DL 309/2009, art. 51, nos. 1 and 4 |

Works that break the law, on classified buildings or in protection zones, can be halted by an embargo (article 50). Do not start without the answer.

### And repairing tile by tile?

The RJUE (urban planning law) exempts maintenance, but does not waive the heritage protection rules (see the [works permit](https://telhadoseguro.pt/en/guides/roof-works-permit-2026)). In the two municipalities we studied, the answer differs. In Guimarães, the Câmara says that in the classified area even maintenance needs a licence, with heritage consultation; in the special protection zone, simple maintenance does not. In Évora, the plan says maintenance works inside the walls have no special restriction, but that in classified buildings only maintenance, restoration and, exceptionally, rehabilitation are authorised. So: **ask before ordering**, even for a small repair.

## Materials and appearance

The law has no list of materials for the whole country. It has three ideas:

- **The special zone may regulate** morphology, colour scheme and exterior cladding, and set how often maintenance works are done (DL 309/2009, art. 43).
- **Near a classified building**, interventions that change volume, nature, morphology or colour scheme may not alter the architectural character of the area nor disturb the view of the building (Lei 107/2001, art. 52, no. 2).
- **The municipal plan can be specific.** In Évora, inside the walls, red ceramic canudo tile is called for, preferably handmade.

The APICER and CTCV guide points the same way: a slope suited to the place and, as far as possible, similar to the neighbours'; reversibility and preservation of identity in rehabilitations; value in ventilated eaves; little mortar. See the [minimum slope](https://telhadoseguro.pt/en/guides/minimum-roof-slope).

## Practical steps

1. **Ask the Câmara** whether there is a classification, protection zone, ARU or plan with rules for the roof.
2. **Hire a qualified technician**, mandatory for classified buildings (art. 45, no. 1).
3. **Ask where the request is filed.** In the protection zone, the opinion is a condition for the Câmara to license. In Guimarães, the Câmara says the opinion comes from the CCDR or from Património Cultural, I.P.; CCDR Algarve reported, in 2024, opinions issued through the SIRJUE platform.
4. **Use only the authorised materials and colours.**
5. **Keep** the opinion, the photographs and the final report. See the [warranty](https://telhadoseguro.pt/en/guides/roof-works-warranty) and [how the job goes](https://telhadoseguro.pt/en/guides/roof-works-when-and-how-it-goes).

## Roofs on the coast

- **More slope.** Cerâmica Torreense treats as «exposed» the coast up to 5 km from the sea, cliffs, islands, estuaries and bays. Between normal and exposed exposure, the tile table asks for 4 to 10 more percentage points, depending on model and zone (our arithmetic, using the table in the [minimum slope](https://telhadoseguro.pt/en/guides/minimum-roof-slope) guide).
- **Zone map.** In the manufacturer's image, the west coast of the mainland appears in zone 3, the most demanding.
- **Salt.** The APICER and CTCV guide explains that salt crystallises inside the tile and makes it flake. It calls for tile with proven freeze-thaw resistance and low water absorption, and for replacing flaked tile. See [tiles by climate](https://telhadoseguro.pt/en/guides/roof-tiles-by-climate).
- **Wind.** Ridges, hips and edges may need mechanical fixings, as the manufacturers indicate.

## Roofs on the islands

In the image of the same map, the Azores appear in zone 3 and Madeira in zone 3 with a patch of zone 2. For Madeira, see [Funchal](https://telhadoseguro.pt/en/roof-repair/funchal), with the regional licensing regime and the historic centre's PDM (municipal plan). National law provides that the special zone of a property in an Autonomous Region is set by the regional body (Lei 107/2001, art. 43, no. 2), so the rules and the counter change with the archipelago.

## What we could not confirm

- **The version in force.** We read the original text of Lei n.º 107/2001 (2001) and a copy of Decreto-Lei n.º 309/2009 updated to 2012, printed in 2015. We did not check later changes, including those to the RJUE in 2026.
- **The time limit for the opinion** and who issues it today in each region.
- **The rules of each ARU and municipal plan** for tile.
- **Properties of municipal interest:** the regime has differences (arts. 57 to 59) that we did not read in depth.
- **The regional laws of the Azores and Madeira** on heritage: we could not open them.
- **Wind and salt data** by locality.

## FAQ

### How wide is the protection zone of a classified building?

The general protection zone is 50 metres from the external limits of the building and applies from the decision to open the classification procedure (Decreto-Lei n.º 309/2009, article 37). There may also be a special zone, set by ministerial order, with another extent and its own rules.

### Do I need a heritage opinion to change the roof in a protection zone?

Lei n.º 107/2001 (article 43, no. 4) says that in protection zones no licences are granted for works that change roofs or exterior cladding without a prior favourable opinion from the heritage administration. Interior-only works are left out (no. 5). We did not confirm what applies to a simple repair: ask the Câmara.

### Does a roof near the sea need special care?

According to Cerâmica Torreense, the coast up to 5 km from the sea and the islands count as «exposed» exposure, which needs more slope. The APICER and CTCV guide says salt can make tile flake and calls for tile with proven freeze-thaw resistance and low water absorption.

### Who issues the heritage opinion?

It depends on the building and the region. The Guimarães Câmara says it usually comes from the CCDR Norte Culture Unit or from Património Cultural, I.P. CCDR Algarve reported, in 2024, opinions issued through the SIRJUE platform. In the Autonomous Regions there are regional bodies (Lei n.º 107/2001, article 43, no. 2).
